Terms & Conditions

1. Definitions

This Rental Agreement ("Agreement") includes all terms and conditions stated here, on your rental invoice, and in any addenda provided at the time of rental.

• “You” / “Your”: The renter named on the Agreement, any person signing the Agreement, any Authorized Driver, or entity assuming financial responsibility.
  
  
• “We” / “Our” / “Us”: Sunset Lux, its employees, agents, affiliates, and assignees.
  
  
• “Authorized Driver”: You, your spouse, employer, co-worker (if on business with you), or any other driver pre-approved and listed by Sunset Lux, each of whom must hold a valid driver’s license and meet our minimum age requirements.
  
  
• “Vehicle”: The luxury or exotic vehicle described in this Agreement, including all tires, keys, equipment, documents, and accessories.

• “CDW”: Collision Damage Waiver.

2. Use of Vehicle / Indemnity

You agree:

• This Agreement constitutes a luxury rental contract, not a lease.
  
  
• To indemnify, defend, and hold harmless Sunset Lux from any claims, losses, or damages, including attorney’s fees, resulting from your use of the Vehicle.
  
  
• That no warranties—express or implied, including merchantability or fitness—are made regarding the Vehicle.

3. Vehicle Condition & Return

• You are expected to return the Vehicle to the specified location on the due date and in the same pristine condition it was rented (excluding normal wear).
  
  
• Unauthorized repairs or servicing are prohibited.
  
  
• We may repossess the Vehicle without notice if it is abandoned or misused.

4. Damage, Loss & Incident Reporting

You are financially responsible for:

• All physical, cosmetic, or mechanical damage (regardless of fault).
  
  
• Loss of use, diminished value, missing accessories, or third-party recovery costs.
  
  
• Theft, vandalism, or unauthorized use (e.g., driven by a non-Authorized Driver).
  
  
• You must report any accident, theft, or vandalism to Sunset Lux within 24 hours and to local law enforcement.
  
  

5. Collision Damage Waiver (CDW)

• Optional CDW is available for purchase and limits your liability for physical damage.
  
  

CDW is voided if the damage results from: a) Reckless or intoxicated driving b) Unauthorized driver operation c) Off-road use d) Use in illegal activity or competitive driving e) Misrepresentation at the time of booking f) Driving outside approved regions or countries

6. Insurance Requirements

• You must carry full coverage insurance (liability, collision, and comprehensive) that transfers to the Vehicle.
  
  
• Uninsured/underinsured motorist coverage must also apply.
  
  

Our liability insurance, if any, is secondary and voided if you violate this Agreement or permit unauthorized use.

7. Charges & Fees

You agree to pay:

• Rental time and mileage as calculated by our systems.
  
  
• Additional driver fees, fuel charges, and charges for optional upgrades (e.g., child seats, delivery).
  
  
• Cleaning fees (up to $150) for excessive interior dirt, odors, or spills.
  
  
• Smoking and pet fees: Minimum $350 per incident.
  
  
• Loss, damage, or diminished value costs.
  
  
• Traffic violations, tolls, towing, storage, or impound expenses.
  
  
• Collection and legal fees, including a 2% monthly late fee and 1% monthly interest (or max legal limit).
  
  
• One-way or abandonment fees: $100 base + $15 per mile outside the rental zone + recovery costs.
  
  

8. Security Deposit & Use of Credit Card

A security deposit (via major credit card or wire) is required and may be used to satisfy any amounts owed under this Agreement. You authorize Sunset Lux to charge your card on file for unpaid balances, damage, or penalties without further approval.

9. Personal Property Waiver

You release Sunset Lux from any responsibility for loss, theft, or damage to personal property stored in the Vehicle, in our offices, or handled by our staff.

10. Prohibited Use & Breach

The following constitute a breach of contract and will void CDW and any protections:

• Use by unauthorized drivers
  
  
• Use in reckless, illegal, or negligent activities
  
  
• Misrepresentation of eligibility or identity
  
  
• Transporting illegal goods
  
  
• Driving outside approved jurisdictions (including international travel unless pre-authorized)
  
  

Breach of this Agreement may result in immediate termination of the rental and full liability for all resulting damages.

11. Modification of Terms

No modifications or waivers are valid unless made in writing and signed by an authorized Sunset Lux representative.
Rental extensions must be approved in advance and are subject to reinspection and reauthorization.

12. Limitation of Liability

Sunset Lux shall not be held liable for any incidental, indirect, or punitive damages, including loss of time, income, or personal inconvenience. Our maximum liability shall not exceed the total amount paid under this Agreement.

13. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of California. Jurisdiction and venue will reside in Los Angeles County, CA.

14. Entire Agreement

This Agreement represents the entire agreement between Sunset Lux and you, superseding all prior oral or written statements regarding this rental.
